Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Australian Property Marketing platform. By creating an account or using APM, you agree to be bound by these Terms. If you do not agree, do not use the service.
These Terms constitute a legally binding agreement between you (or the agency you represent, "Customer") and Australian Property Marketing Pty Ltd (ACN to be inserted) ("APM", "we", "us").
1. Service description
APM is a software-as-a-service (SaaS) platform that enables Australian real estate agencies to:
- Create and manage property listings
- Distribute listings to multiple real estate portals via REAXML syndication
- Manage portal credentials in a secure, centralised dashboard
- Monitor listing status and receive leads from connected portals
- Manage agency team members, roles, and permissions
APM operates as an intermediary between your agency and real estate portals. You remain responsible for the accuracy of all listing data submitted through APM and for maintaining valid accounts with each portal you syndicate to.
2. Account registration
To use APM, you must create an account using a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring all users you add to your organisation comply with these Terms
- Providing accurate and current account information
You must notify us immediately of any unauthorised use of your account at info@australianpropertymarketing.com.au.
3. Free trial
APM offers a 14-day free trial for new accounts. During the trial:
- No payment information is required
- You may access up to 5 active listings and 2 portals
- All platform features are available within trial limits
At the conclusion of the trial, your account will revert to a read-only state. No charges are applied automatically. You must select a paid plan to continue using APM.
4. Subscription and billing
4.1 Plans and pricing
APM offers the following paid subscription plans:
- Starter — $149 AUD per month
- Pro — $299 AUD per month
- Enterprise — Custom pricing by agreement
All prices are inclusive of GST where applicable.
4.2 Billing cycle
Subscriptions are billed monthly. Your billing cycle commences on the date you activate a paid plan. APM uses a manual billing workflow — our team will confirm payment details with you after sign-up.
4.3 Payment
Payment is due within 7 days of invoice. Late payments may result in suspension of your account until the outstanding balance is cleared. We reserve the right to charge interest on overdue amounts at the rate permitted by the Late Payment of Commercial Debts Act.
4.4 Price changes
We may change subscription prices with 30 days' written notice. Continued use of APM after the price change takes effect constitutes acceptance of the new pricing.
5. Acceptable use
You agree not to use APM to:
- Submit false, misleading, or fraudulent property listings
- Violate any applicable law, including Australian consumer law
- Infringe the intellectual property rights of any third party
- Attempt to gain unauthorised access to our systems or other accounts
- Reverse engineer, decompile, or disassemble any part of the APM platform
- Use the platform for any purpose other than real estate listing management
- Share your account credentials with individuals outside your agency
Violation of this acceptable use policy may result in immediate suspension or termination of your account without refund.
6. Your content and data
You retain all ownership of listing data, photos, and other content you upload to APM ("Customer Data"). By using APM, you grant us a limited licence to store, process, and transmit your Customer Data solely to provide the APM service.
You represent and warrant that:
- You have all necessary rights to the content you upload
- Your content does not infringe any third-party rights
- Listing information you submit is accurate to the best of your knowledge
7. Portal accounts and credentials
By connecting a portal account to APM, you authorise us to access and use that portal account on your behalf solely for the purpose of listing syndication. You remain solely responsible for:
- Maintaining valid accounts with each portal
- Complying with each portal's own terms of service
- Any fees charged by portals for listing submissions
APM is not affiliated with realestate.com.au, Domain, or any other portal. Portal availability within APM may change if a portal modifies its API or access terms.
8. Cancellation
8.1 Cancellation by you
You may cancel your APM subscription at any time by contacting us at info@australianpropertymarketing.com.au. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.
8.2 Cancellation by APM
We may suspend or terminate your account if you breach these Terms, fail to pay invoices, or if we reasonably believe your use of APM poses a risk to other users or our systems. We will provide reasonable notice where practicable.
8.3 Effect of cancellation
Upon cancellation, your access to APM will cease at the end of the billing period. We will retain your data for 90 days after cancellation, after which it will be deleted. You may request an export of your data before this period expires.
9. Intellectual property
The APM platform, including all software, design, branding, and documentation, is the intellectual property of Australian Property Marketing Pty Ltd and is protected by Australian copyright law. Nothing in these Terms transfers any intellectual property rights to you.
10. Disclaimer of warranties
APM is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
We do not warrant that APM will be uninterrupted, error-free, or completely secure. Real estate portal connectivity may be disrupted by factors outside our control, including portal API changes or outages.
11. Limitation of liability
To the maximum extent permitted by law, APM's total liability to you for any claim arising under or in connection with these Terms is limited to the total subscription fees you paid to APM in the 3 months immediately preceding the claim.
APM is not liable for any indirect, incidental, consequential, or special loss or damage, including loss of revenue, loss of listings, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such loss.
Nothing in these Terms limits liability that cannot be excluded under Australian law, including liability under the Australian Consumer Law for non-excludable consumer guarantees.
12. Indemnification
You agree to indemnify and hold harmless APM and its officers, directors, and employees from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of any third-party rights, or any inaccurate listing data you submit through APM.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales for resolution of any dispute.
14. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of APM after the effective date constitutes acceptance of the updated Terms.
